Terms of Service

These Terms of Service ("Terms") govern your use of website-building services provided by ZenNextStudio (operated under AI Enterprise, Mumbai, India). By submitting a request through our website or engaging our services, you agree to these Terms.

1. What We Provide

ZenNextStudio designs and builds a custom website based on the information, content, and images you provide. Our fee covers the design and development of the website only, unless a specific package explicitly states otherwise.

2. Payment Terms

• Payments are processed through Razorpay. We do not store your card, UPI, or banking details on our servers.
• The Self-Service Launch Offer (₹999+GST registration) and Starter package are one-time fees covering website design/registration and development only. They do not include ongoing hosting beyond the free introductory period stated on the Pricing page, domain registration, or maintenance beyond the initial build.
• The Business package is a one-time fee of ₹17,700 (GST-inclusive) covering design and development, plus a recurring ₹1,499/month maintenance fee for ongoing hosting, support, and minor updates.
• The Growth package (₹3,999+GST/month, or billed annually at a discount) is a recurring subscription that includes ongoing hosting and monthly content updates for as long as the subscription remains active and paid. Either party may cancel with 30 days' written notice; fees remain payable through the end of that notice period.
• Fees are non-refundable once work on your website has begun, except where required by law.

3. Hosting & Domain

Hosting is a separate, ongoing service from website development. See our Hosting Policy for full details on what is included with each package and what happens if hosting is discontinued.

4. Client Responsibilities

• You are solely responsible for the accuracy, legality, and ownership of all content, images, product listings, and business information you submit.
• You are responsible for your own business operations, products, services, pricing, and any transactions conducted with your customers — including those initiated via WhatsApp, phone, or any contact method on your website.
• You must have the right to use any images, logos, or content you upload. Do not submit copyrighted material you don't own the rights to.
• You are responsible for complying with all applicable laws relevant to your business (GST, consumer protection, industry-specific regulations, etc.).

5. Prohibited Use

We reserve the right to refuse service, suspend, or take down any website found to be used for illegal activity, fraud, scams, or content that violates applicable law. No refund will be issued in such cases.

6. Limitation of Liability

ZenNextStudio provides website design and hosting infrastructure services. We are not responsible for and hold no liability for any disputes, losses, fraud, or damages arising from transactions, products, or services offered by you through your website. Our liability, where applicable, is limited to the fees paid for the specific service in question.

7. Changes & Updates

Requests for changes to a live website after delivery are handled on a case-by-case basis and may incur additional charges depending on scope, unless covered under an active Growth package.

8. Termination

Either party may discontinue services at any time. If you discontinue hosting services, your website may go offline. We will provide you a copy of your website files upon request within a reasonable period after service ends.

9. Fraud Monitoring & Suspension

ZenNext Studio reserves the right to monitor client websites and associated order/transaction activity for patterns indicative of fraudulent behaviour, including abnormal order volumes, repeated chargebacks/disputes, mismatched billing/shipping info. Where detected, ZenNext Studio may suspend/restrict access to the affected site pending investigation, without prior notice, to protect end customers and platform integrity.

10. Client Liability Disclaimer

The Client is solely responsible for all products, services, content, and transactions on their website. ZenNext Studio (AI Enterprise) acts solely as a hosting/technology provider and is not a party to transactions between Client and their customers. ZenNext Studio is not liable for any loss, fraud, or dispute arising from Client's use of the platform, including fraud committed by the Client or through the Client's site. Client agrees to indemnify ZenNext Studio/AI Enterprise against such claims.

11. KYC Condition

As a condition of onboarding, Client agrees to provide accurate identity/business verification documents as requested. ZenNext Studio may withhold, delay, or suspend site access pending verification, and may re-verify periodically.

12. Domain & Document Ownership

All domains, business registration documents, and related legal records shall be registered solely in the Client's (or Client's business entity's) name. ZenNext Studio/AI Enterprise shall never register such domains/documents in its own name.
